Although often forgotten, GINA is another potential hazard for employers.  In EEOC v. Founders Pavillion, Inc., the employer settled with the EEOC over claims that its practice of asking for medical family history in its pre-employment, return to work, and annual medical examinations violated GINA.  Several years earlier, the EEOC made the same argument against Fabricut, one of the largest distributors of decorative fabrics, that its post-offer medical examination improperly inquired about family medical history.
